Prosecutorial Misconduct May Affect Jury Selection in Criminal Cases

Hartford, CT criminal defense lawyerPeople who are accused of crimes often feel that they are at a disadvantage when defending against criminal charges. Prosecutors have significant resources available to them, and in some cases, they may engage in misconduct that affects the fairness of criminal proceedings. One issue that can play a role in many cases is jury selection, and when prosecutors engage in discrimination and other Constitutional violations when selecting the members of a jury, this can lead to unjust results, including wrongful convictions or unfair sentences.

Because of the serious nature of criminal cases and the methods used by prosecutors to secure convictions, it is crucial for defendants to make sure they have legal representation. An experienced Hartford, CT criminal defense attorney can work to make sure a defendant’s rights are protected, develop a strong defense strategy, and pursue appeals if necessary to address prosecutorial misconduct or other issues that led to wrongful convictions.

California Investigations Reveal Prosecutorial Misconduct in Death Penalty Cases

Prosecutors have a great deal of power in criminal cases. They have access to information and evidence obtained during investigations, and they determine what charges to pursue and whether plea bargains may be used. However, they are also bound by the law, and they are prohibited from engaging in practices that violate the Constitutional rights of defendants. One area of concern that has recently been highlighted involves the practices followed when selecting juries in criminal cases.

Both prosecutors and defense attorneys may try to ensure that juries are made up of people who are likely to vote in their favor. During criminal trials, juries are selected from a pool of potential jurors, but both sides have the opportunity to dismiss a certain number of jurors. While prosecutors may dismiss jurors who they believe are less likely to vote for a conviction, they are prohibited from dismissing jurors based on certain factors. In 1986, the U.S. Supreme Court ruled in the case of Batson v. Kentucky that prosecutors cannot eliminate jurors based solely on their race.

Unfortunately, it can be difficult to determine the reasons that prosecutors dismiss jurors. Even though they may dismiss a large number of jurors of a certain race, they may claim that these dismissals were based on other factors, such as the jurors’ stated views on punishments for certain crimes. However, criminal justice advocates are working to expose illegal practices by prosecutors and seek justice for defendants whose rights have been violated.

Recently, an investigation in Alameda County, California uncovered a history of unethical practices by prosecutors who worked to secure death penalty sentences in capital murder cases. When reviewing past cases, officials in the district attorney’s office uncovered notes that prosecutors had compiled about certain potential jurors stating that they should be dismissed because they were Black or Jewish. Additional investigations found that prosecutors followed unofficial policies in which they always dismissed Jewish jurors because they were less likely to vote for the death penalty. They would also often dismiss Black jurors, especially Black women, in cases involving Black defendants. Based on this investigation, several cases are being reviewed to determine whether convictions should be reversed or whether resentencing will be appropriate.

While this investigation was limited to one county in California, it is highly likely that prosecutors throughout the United States are engaging in similar practices. Defendants have certain rights that should be protected, and they should be treated fairly during their cases. Representation from a skilled criminal defense attorney is crucial to ensure that a person’s rights are protected. Those who have been wrongfully convicted due to prosecutorial misconduct will need to understand their options for filing appeals or seeking other forms of post-conviction relief.
